Mac Mail Spell Check Dialogue Box Won

Mac Mail v. 6.2 on Mountain Lion....when I set the spell checker to run when a message is sent, it wants to check the quoted text also.

If I hit Send a second time so it stops checking quoted text, the message is sent, BUT the spell check dialogue box doesn't disappear until I manually force it to close.

Anyone know how to a) stop it from checking quoted text, or b) make that box go away by itself?
